From Frolic's email list 2006-11-22:It is with a very heavy heart that I inform YOU, our loyal army of fans, that FROLIC will be no more... or the name at least. With the international exposure we received from the ABC commercial that featured "The Waiting Is Over", we've recently been served with a C & D (a cease & desist order) for using the name Frolic from another band named Frolic from the east coast. They are claiming to have been using the name Frolic since almost the same time we starting using it. We've decided, along with our management team and publicist, to retire the name and change it to a name that suits us better. The band name was founded in a time in our lives where things weren't so hectic. The last 6 years or so have brought a lot of ups and even more downs for us as a band. I considered changing the name of the band after the death of our guitarist and friend Matt Setzer, but the timing and transition didn't feel right along with the insecurity of letting go of a project "name/label" that took us years to build. It has occurred to us that we could fight for the name and possibly win. The downside would be the time & money spent on the court case and our inability to release anything under the name Frolic during the court battle. This is not a bet we felt comfortable taking with the incredible things coming for the band in 2007.
We currently have a few ideas in mind that we feel fit our sound and image much better, but we're more than open to suggestions. This week we are announcing the official change of the bands name from "Frolic" to "The Opus Flux". New marketing for the change begins this week and we need your help. Anyone who is interested in helping us with The Opus Flux Street Team please contact me here. This will come with the new merchandise perks for anyone that is able to help us. This is really big for us and you now have a chance to be involved. Even if you can't help physically, please spread the word to anyone you can find via text messaging, group emails, as well as hitting up all your Myspace friends to get them involved. Our success in this transition depends greatly on YOU!
